Johnny Loper was a featured speaker at the 25th Annual Regulatory Law Seminar presented by the Federation of Association of Regulatory Boards (FARB) on October 5-8 in Savannah, Georgia.
FARB was formed in 1974 as a 501(c)(3) not-for-profit member association dedicated to excellence in the regulation of licensed professionals. FARB currently has twenty-one governing member associations of boards representing multiple licensed professions. This year, 175 assistant attorneys general, board attorneys, board members, and board executive directors from across the country attended the Seminar.
Loper spoke on "Separation (or Comingling) of Powers: the Authority of the Executive and Legislative Branches of Government." His presentation included both a follow-up to his FARB presentation two years ago on the North Carolina State Board of Dental Examiners v. The Federal Trade Commission U. S. Supreme Court 2015 case that changed the national landscape for professional licensing boards, as well as a discussion of various state executive orders issued and legislative actions taken across the country in response to the Dental Board case --- among the most interesting of those being a series of lawsuits filed by Kentucky's Attorney General against the Commonwealth's Governor to enjoin the Governor from "firing" legislatively-created licensing boards and re-constituting them with different members and powers.
Johnny Loper is a trial attorney who has litigated complex business cases with at-risk amounts in the hundreds of millions of dollars. He also is a recognized authority on professional licensing board administrative law, and has lectured often at legal education programs and programs for licensing board attorneys and administrators.
