On August 22, 2019, the Vietnam's Prime Minister signed Decision No. 1068 / QD-TTg approving the Vietnam's IP Strategy to 2030 (the "Strategy").

The Strategy was developed by the Ministry of Science and Technology, in collaboration with related ministries and sectors and the technical support of the WIPO. This is the first time Vietnam has issued a national strategy on IP, marking a new development step in this field, affirming its importance in promoting innovation activities, economic, cultural and social development of the country. The Strategy consists of three parts:

- Guiding views;

- Objectives; and

- Tasks and solutions.

The content components of the Strategy are built according to the cycle of IP activities, including Creation, Establishment, Protection and Exploitation of IPRs.

1. Guiding views

The strategy to guide the development of Vietnam's IP system is based on three major guiding views, namely:

- Develop a comprehensive and effective IP system at all stages, creating an environment to encourage innovation and meet requirements. International integration to make IP becoming an important tool to enhance national competitiveness, promote economic, cultural and social development.

- IP policy is an inseparable part of national economic, cultural and social development strategies and policies.

- IP activities with active participation of all entities in society, including research institutes, universities, creative individuals, especially enterprises playing a role mainstreaming in the creation and exploitation of IP.

2. Objectives

Based on these guiding views, the Strategy sets out 5 objective groups, namely:

- By 2030, Vietnam is one of ASEAN leading countries in terms of creativity, protection and exploitation of IPRs.

- The establishment of IPRs and rights to plant varieties ensures fast, transparent, fair and timely response to the requirements of enterprises and society.

- The enforcement of IP law has been significantly improved, the situation of infringement of IPRs decreased significantly.

- New IP of Vietnamese individuals and organizations increased both in quantity and quality, dramatically improving Vietnam's IP indices in the global innovation index. For this purpose, quantitative indicators are clearly defined.

- Effective use of IPRs is enhanced and significantly increases the number of products with high IP content

3. Tasks and solutions

In order to achieve the set goals, the Strategy sets out nine task groups and solutions:

i (i) Completing policies and laws on IP;

ii (ii) Improve the effectiveness and efficiency of state management of IP;

iii (iii) Focus on promoting and improving the effectiveness of IPRs enforcement;

iv (iv) Promote IP creation activities;

v (v) Encourage and improve the efficiency of IP exploitation;

vi (vi) Develop IP support activities;

vii (vii) Strengthen human resources for IP activities;

viii (viii) Forming a culture of IP in society; and

ix (ix) Actively, proactively cooperating and international integration on IP.

The effectiveness of IPRs protection should be significantly improved through the promotion of coordination activities between rights protection agencies, strengthening inspection and strict handling of infringements of rights. IP, especially in digital environments and at the border; improve the efficiency of investigating criminal cases of IP.

The Strategy also goes beyond the traditional scope of IP activities (focusing mainly on the establishment and protection of IPRs) when identify more tasks and solutions to promote activities of creating and exploiting IP such as building and providing IP information tools and services, technology maps for Research institutes, universities, enterprises; use indicators of IP as a basis for assessing the performance of research institutes, universities and enterprises; forming and developing a network of centers for technology and IP transfer at research institutes, universities and enterprises; promote the implementation of mechanisms and policies to develop industries with high levels of IP use, creating prestigious and quality products, promoting the export of goods with high IP content; guide and support enterprises to step up the use of IP tools in their production and business activities; developing a healthy IP market in the direction of expanding and improving the quality of intermediary services to enhance the supply and demand connection of IP; promote assessment, valuation of IP, etc.

In addition, forming an IP culture is a primary task and solution, an IP system operates effectively only when the whole society has a sense of respect and protection. IPRs.
