PLANNING UPDATE (AUSTRALIA)

The State Development, Infrastructure and Industry Committee announced yesterday that it has tabled its Report No. 13 - Sustainable Planning and Other Legislation Amendment Bill 2012.

We made submissions to the Committee about the proposed reforms and were invited to give evidence before the inquiry on 25 October 2012 ( transcript). One of our key submissions related to the proposal to have costs of proceedings follow the event (essentially, the loser pays). In considering these submissions, the Committee has recommended that the words 'but follow the event, unless the court orders otherwise', be removed from the Bill.
