On December 24, 2018, the Federal Environmental Council published Resolution No. 492 ("Resolution"), regulating two phases of the Air Pollution Control Program for Vehicles ("PROCONVE") for new light motor vehicles for road use.

The first phase aims to establish, from January 1, 2022 on, new maximum levels for the emission of pollutants for light, passenger and commercial road vehicles, domestic and imported, for sale in the country ("Phase PROCONVE L7").

The second phase pursues, from January 1, 2025 on, to establish new corporate emission limits for light commercial passenger and light commercial vehicles, domestic and imported, sold in the country ("Phase PROCONVE L8 ").

Further, among the innovations brought by the Resolution, we highlight:

  • As of 2020, Federal Environmental Agency will publish the averages for each year of all the organic compounds mentioned in the Resolution, to support scientific studies related to the control of air pollution;
  • Establishment of maximum limits and of evaporative and supply measurements;
  • Establishment of vehicle noise emission limits;
  • Establishment of procedures to sample emissions of pollutants from the vehicles' exhaustion system and the guarantee of durability of emissions.
