O Plenário do Tribunal de Contas da União (TCU) aprovou recomendação monocrática para criação de um comitê formado pelo Ministério Público Federal, Ministério da Transparência e Controladoria Geral da União (CGU), Advocacia-Geral da União e do CADE, além do próprio TCU.

O TCU reconheceu que a falta de coordenação entre os órgãos de persecução Anticorrupção produz insegurança jurídica e compromete a efetividade dos acordos de leniência da Lei n. 12.846/2013 (Lei Anticorrupção) assinados com cada autoridade competente de forma isolada.

A deliberação é uma importante mensagem do TCU sobre a imprescindibilidade de participação concomitante de todos os interessados na negociação e assinatura de acordos de leniência.

A aplicação da Lei Anticorrupção pode atrair a competência do TCU para ressarcimento de eventuais danos ao erário e declaração de inidoneidade de indivíduos e pessoas jurídicas infratoras.
