On this Wednesday, 12, Justice Luiz Fux revoked the injunction
previously granted by him, which suspended the imposition of fines
and indemnities arising from the non-compliance with the Minimum
Freight Table.
The Decision derives from a request made by Federal General
Attorney, which claimed that the Minimum Freight Table ensured the
normality in the Brazilian highways and the distribution of
essential products and services to the population. Justice Fux
revoked the injunction convinced that there was an inverse
periculum in mora, also emphasizing his preference for consensual
solutions.
Therefore, the legal authorization for inspection activities by
ANTT is back in force, including the imposition of the fines
regulated by ANTT's Resolution No. 5,833, and the transporter
indemnities.
