On April 24, 2019, Ordinance No. 299 ("Ordinance") was published, creating a Working Group empowered to regulate the Decree No. 9,760/2019 ("Decree"), which establishes proceedings regarding the conversion of fines and Conciliation Hearing in environmental processes.
The Working Group will be constituted by federal agencies in charge of the inspection of environmental violations and by the Ministry of Environment.
Also, the Working Group will be responsible for:
- prepare proposals for new rules to regulate the Decree;
- identify, discuss and review the technical and legal feasibility of such drafts;
- prepare periodic report on the progress of proposals for new rules.
It is important to highlight that the Working Group will have 180 days, as of publication of the Ordinance, to conclude its work.
