STF DETERMINA A SUSPENSÃO DE TODOS OS PROCESSOS CRIMINAIS ORIGINADOS A PARTIR DO COMPARTILHAMENTO DE DADOS FISCAIS COM O MINISTÉRIO PÚBLICO SEM PRÉVIA AUTORIZAÇÃO JUDICIAL

O Supremo Tribunal Federal, por meio de seu presidente, o
Ministro Dias Toffoli, determinou a suspensão de todos os
processos criminais, no âmbito nacional, que tenham sido
originados a partir do compartilhamento de dados fiscais ou
bancários, por parte da Receita Federal, Banco Central ou
Coaf, com Ministério Público, sem prévia
autorização judicial.
Os prazos prescricionais dos processos também
ficarão suspensos. Essa decisão não atinge
procedimentos em que o compartilhamento de dados com o
Ministério Público tenha se limitado à
identificação das operações
bancárias e dos montantes globais.
A decisão foi tomada em um Recurso Extraordinário
(RE 1055941), cuja repercussão Geral já havia sido
reconhecida pelo STF. Há previsão de que o caso venha
a ser julgado em 21 de novembro deste ano.
