Mon collègue Mat Brechtel explique (en anglais seulement) que la Cour fédérale a décidé que Hidden Bench Vineyards & Winery Inc. (Hidden Bench) ne peut pas utiliser sa marque non enregistrée LOCUST LANE afin d'empêcher l'utilisation de la même marque par Locust Lane Estate Winery Corp. (LLEW). La Cour a écrit que Hidden Bench a utilisé LOCUST LANE comme une marque de commerce, et non seulement comme une description de l'origine géographique. Néanmoins, Hidden Bench n'a pas réussi dans sa demande à la Cour parce qu'elle n'a pas démontré :

  • que LOCUST LANE a acquis un caractère distinctif;
  • qu'il y a de l'achalandage dans LOCUST LANE afin de trouver la confusion entre les vins LOCUST LANE de Hidden Bench et les vins de LLEW; et
  • que LLEW a fait passer ses vins pour ceux de Hidden Bench.

Les difficultés d'Hidden Bench sont un bon rappel de l'importance d'enregistrer vos marques de commerce. L'enregistrement offre plusieurs avantages, dont la présomption de validité, l'annonce de l'existence de la marque, et le droit exclusif à l'emploi de la marque partout au Canada.
