China: 外国人申请永久居留资格实务操作指南

随着经济的发展和全球人才的交流密集化,越来越多的外国人选择在中国工作和定居,中国政府也顺应了这一潮流,在最近几年纷纷推出了一系列方便外国人申请在华永久居留权的法规、政策和操作规程。笔者根据申请永久居留权的法律法规,收集了杭州、上海两地的具体申请流程,整理归纳了外国人申请永久居留资格的条件以及实际操作流程,为外籍人士在中国申请永久居留资格提供帮助和指引。

一、外国人申请永久居留资格的条件

根据人力资源和社会保障部在2004年8月15日颁布的《外国人在中国永久居留审批管理办法》(以下简称"《管理办法》"),外国人申请永久居留资格可分为投资类、任职类、特殊贡献类以及亲属投靠类。

这四类人士除了需要符合四类具体的规定之外,均需要遵守中国法律,身体健康,无犯罪记录。下面对四类人士的具体要求进行详细阐述:

(一)投资类

《管理办法》第六条第一款第一项对投资类人士的要求为"在中国直接投资、连续三年投资情况稳定且纳税记录良好的。"

在《管理办法》第七条对投资类人士的要求进行了具体的描述,要求投资类人士在中国投资实际缴付的注册资本金应当符合下列条件之一:

1.在国家颁布的《外商投资产业指导目录》鼓励类产业投资合计50万美元以上;

2.在中国西部地区和国家扶贫开发工作重点县投资合计50万美元以上;

3.在中国中部地区投资合计100万美元以上;

4.在中国投资合计200万美元以上。

(二)任职类

《管理办法》第六条第一款第二项对任职类人士的要求为"在中国担任副总经理、副厂长等职务以上或者具有副教授、副研究员等副高级职称以上以及享受同等待遇,已连续任职满四年、四年内在中国居留累计不少于三年且纳税记录良好的。"但是该条件并不是绝对的,根据国务院办公厅于2016年2月18日发布的《关于加强外国人永久居留服务管理的意见》第九条的规定,职务级别以及聘雇单位的范围都会根据经济社会发展的需要进行相应调整。

《管理办法》第八条对任职类人士的要求进行了具体的描述,要求任职类人士的任职单位应当符合下列条件之一:

1.国务院各部门或者省级人民政府所属的机构;

2.重点高等学校;

3.执行国家重点工程项目或者重大科研项目的企业、事业单位;

4.高新技术企业、鼓励类外商投资企业、外商投资先进技术企业或者外商投资产品出口企业。

(三)特殊贡献类

《管理办法》第六条第一款第三项对特殊贡献类人士的要求为"对中国有重大、突出贡献以及国家特别需要的。"

《管理办法》第十二条对特殊贡献类人士的要求进行了具体的描述,要求特殊贡献类人士能够提交中国政府主管部门出具的推荐函及有关证明。

(四)亲属投靠类

《管理办法》第六条第一款第四项至第七项对亲属投靠类人士的要求及需要提交的相应文件规定如下:

1.投资类、任职类、特殊贡献类三类人员的配偶及其未满18周岁的未婚子女。

2.中国公民或者在中国获得永久居留资格的外国人的配偶,婚姻关系存续满五年、已在中国连续居留满五年、每年在中国居留不少于九个月且有稳定生活保障和住所的;

3.未满18周岁未婚子女投靠父母的;

4.在境外无直系亲属,投靠境内直系亲属,且年满60周岁、已在中国连续居留满五年、每年在中国居留不少于九个月并有稳定生活保障和住所的。

二、外国人申请永久居留资格的法定程序

(一)申请材料

投资类、任职类、特殊贡献类以及亲属投靠类四类在申请材料上,除均需2寸近期证件照、提交有效外国护照、健康书、国外无犯罪记录证明等基本资料外,还需按照不同类别提供相应的额外资料。

1.投资类人士在申请时还需提交外商投资企业批准证书、登记证明以及联合年检证明、验资报告、个人完税证明;鼓励类外商投资企业还应当提交国家鼓励发展的外商投资项目确认书。

2.任职类人士在申请时还需提交任职单位出具的本人职务或者职称证明;《外国专家证》或者《外国人就业证》;任职单位的登记证明以及年检证明、个人完税证明;任职单位是外商投资企业的,还需提交外商投资企业批准证书和联合年检证明;在执行国家重点工程项目或者重大科研项目的企业、事业单位中任职的人员需提交省、部级政府主管部门出具的项目证明文件;在高新技术企业中任职的人员需提交高新技术企业证书;在鼓励类外商投资企业、外商投资先进技术企业或者外商投资产品出口企业中任职的人员需提交国家鼓励发展的外商投资项目确认书或者外商投资先进技术企业确认书或者外商投资产品出口企业确认书。

3.特殊贡献类人士在申请时还需提交中国政府主管部门出具的推荐函及有关证明,如有关奖励、成果证明复印件。

4.亲属挂靠类人士可分为夫妻团聚人员、亲子团聚人员以及亲属投靠人员来区分申请时额外需提交的材料。

其中,夫妻团聚人员需提供婚姻证明复印件、配偶的身份证明复印件、房屋租赁或者产权证明复印件以及生活保障证明复印件。

亲子团聚人员需提供出生证明或亲子关系证明复印件、中国籍父母一方的身份证明材料复印件或外国籍父母一方的有效护照及《外国人永久居留证》复印件。如父母双方已离异,应出具被投靠人对申请人具有监护责任关系的证明复印件。

亲属投靠人员需提供申请人在国外无直系亲属证明复印件、国内亲属关系证明复印件、被投靠中国公民常住户籍证明及居民身份证复印件;或者被投靠外国人的有效护照及《外国人永久居留证》复印件、房屋租赁或者产权证明复印件以及生活保障证明复印件。

如果上述四类材料中有外国有关机构出具的证明,该证明需经中国驻该国使、领馆认证。

(二)受理机关

符合条件并且准备好相关材料的外国人士,需向主要投资地或长期居留地设区的市级人民政府公安机关或直辖市公安分、县局提交相应的材料进行申请。各省、自治区、直辖市公安厅、局将进行审核,最后公安部进行审批。

(三)审查期限

公安机关自受理外国人在中国永久居留的申请之日起六个月以内做出批准或者不批准的决定。

(四)审查结果

被批准在中国永久居留的外国人,将由公安部签发《外国人永久居留证》。

需要指出的是,自2017年6月16日起,公安部对经批准取得在华永久居留资格的外国人签发外国人永久居留身份证,不再签发外国人永久居留证。

(五)申请费用

永久居留申请费用人民币1500元/人,证件费300元/人。

三、各地具体操作

随着社会经济生活的发展,自2004年就开始实施的《管理办法》部分条款已与实际社会情况不完全匹配。因此,国务院办公厅于2016年2月18日发布了《关于加强外国人永久居留服务管理的意见》,该意见中要求调整来华投资外国人申请永久居留条件,完善外国人从工作居留向永久居留的转换机制,推动建立以市场为导向的人才永久居留申请标准。现中国各大城市对办理外国人永久居留身份资格的具体操作事宜略有不同,本文收集了杭州、上海两地的具体程序,以供相关人士参考。

(一)杭州

1.特殊政策

杭州对《管理办法》中的特殊贡献类人士的条件和范围进行了细化,主要有以下几点:

(1)符合《杭州国家自主创新示范区外籍高层次人才认定标准》的,经由杭州高新技术产业开发区、杭州大江东产业集聚区、杭州城西科创产业集聚区管委会等单位推荐,可以申请办理外国人永久居留。

外籍高层次人才是指杭州"1+6"产业集群[1]和七大未来产业[2]中的创新创业人才。外籍高层次人才可具体分为五类:

a.顶尖人才。主要包括:诺贝尔奖获得者;美国国家科学奖章、英国皇家金质奖章、邵逸夫奖等奖项获得者;发达国家最高科学技术奖获得者;外国国家科学院院士、工程院院士,或相当于中国"两院"院士的人才;外国国家国立研究所或国家实验室主要负责人;外国国家国家级科技计划项目成果负责人、首席科学家;相当于上述层次的人才。

b.领军人才。主要包括:国家"千人计划"人选;浙江省"千人计划"人选;杭州市全球引才"521"人选;中国政府友谊奖获得者;各国青年类奖项获得者;担任过国际高水平科技期刊(JCR一、二区)正、副总编;曾在外国政府机构担任部长级以上领导职务、在著名国际组织或非政府组织中担任高级领导职务;曾获著名文学奖、著名电影、电视、戏剧奖、著名音乐奖、著名广告奖中最高级别个人奖项及国际著名艺术比赛一类比赛大奖、一等奖或二类比赛大奖个人奖获得者;著名建筑奖获得者;著名工业设计奖获得者;担任过国际标准化组织(ISO)等国际知名学术机构和科教类国际组织委员;曾任世界500强企业总部主要负责人和技术研发负责人;曾任国际著名金融机构、国际著名会计师事务所主要负责人或高级合伙人;世界著名音乐、美术、艺术学院校长、副校长;相当于上述层次的人才。

c.高端人才。主要包括:国家级引智计划项目人选;浙江省海外工程师引进计划人选;杭州市"115"引进国(境)外智力计划高端年薪资助项目人选;入选杭州市"131"中青年人才培养计划的培养人选;浙江省外国专家"西湖友谊奖"获得者;杭州市外国专家"钱江友谊奖"获得者;奥运会或近两届列入奥运会项目的世界杯、世锦赛及其他重要国际赛事进入前三名的运动员;持有国际通用最高等级职业技能资格证书或我国高级技师职业技能资格证书的高技能人才;曾任国(境)外高水平大学(上海交通大学世界大学学术排名(ARWU)、英国《泰晤士高等教育》杂志THE世界大学排名、英国QS世界大学排名、美国usnews世界大学排名(USNews)上年排名前100名)教授及以上;相当于上述层次的人才。

d.高级人才。主要包括:以拥有的技术发明、专利等自主知识产权或专有技术出资,连续3年投资情况稳定、企业实际资本累计不低于100万美元、个人股份不低于30%的企业创始人;以拥有的技术发明、专利等自主知识产权或专有技术出资,连续3年年销售额500万元人民币以上或年纳税额50万元人民币以上的企业董事长、法定代表人、总经理或首席技术专家;中国境内从事博士后研究的人才,来杭创业创新,且符合我市产业导向的人才;"创客天下﹒杭州市海外高层次人才创新创业大赛"总决赛一、二、三等级获得者;在世界技能大赛中获得金银铜奖、国家级以上的建筑、设计、烹饪、茶艺等技能大赛中的金银奖获得者或从事其竞赛项目培训的工匠型人才;相当于上述层次和水平的人才。

e.其他人才。国家外专局、人社部、外交部、公安部关于《全面实施外国人来华工作许可制度的通知》[外专发2017(40)号]认定的其他A类外国高端人才。

(2)在杭州工作且具有博士研究生以上学历的外籍华人,可以申请外国人永久居留。

(3)外籍华人在杭州已连续合法工作满四年,每年在中国境内居住累计不少于6个月,可以申请外国人永久居留。

(4)外籍人员已在杭州连续工作满4年、每年在我国境内实际居留累计不少于6个月,有稳定生活保障和住所,工资性年收入达到50万和年缴纳个人所得税达到10万,经工作单位推荐,可以申请在华永久居留,并允许其配偶和未成年子女随同申请。

2.外籍高层次人才申请材料

外籍高层次人才在申请永久居留前,还需申请对高层次人才进行认定。外籍高层次人才的申请材料如下:用人单位申请、单位承诺书、个人承诺书、《外籍高层次人才资格认定登记表(推荐申请在华永久居留)》、申请人本人有效护照复印件、证明其属于外籍高层次人才的相关材料。

证明属于外籍高层次人才的相关材料如下:

(1)知名奖项获得者须提交奖项获奖证书;知名学者、专家须提交符合国际公认的专业成就认定标准的证明材料;

(2)高层次人才计划入选者须提交有关证书、证明或含入选者的证明文件(发文名单);

(3)以拥有的重大技术发明、专利等自主知识产权或专有技术出资的创业者,须提交投资证明材料(包括所投资公司工商企业营业执照副本、公司章程、入账单、投资证明书等);

(4)各类技能大赛获奖证书、证明或奖章;

(5)外国专家局签发的《外国人工作许可证(A类)》;

(6)其他必要的证明材料。
