  面试材料简介

  面试材料主要为:《鉴定书》、实习律师证、实习训练手册(厚厚的蓝色笔记本)、结业证书原件。

  《鉴定书》中对10个案件总结的内容应当尽可能写的充实,这样可以提高案件由你亲自参与的可信度。

  小技巧分享

  (一)材料准备的一些技巧

  以正合,以奇(ji第一声)胜,【孙子兵法】认为应当将队伍分为两队(奇偶队),比如一队从正面冲击,一队从侧面呼应,用当下时髦的话来说:你要有一套自己的Plan B,我知道大家今天来并不是冲着我将官方标准一个字一个字念一遍来的。同样,今天一小时的分享,也不允许我这么做,因此,我为大家准备了一些遇见特殊情况下的应对方案。

  1、 找不到指导老师签字

  有些朋友的指导老师因为业务太繁忙能见上几面都很奢侈,因为律师本身就是一个特别繁忙的职业。如果确实找不到老师签字,可以采用与指导老师协商的方式,由老师授权由其他律师代签字。一旦面试老师问起来,如实告知,不要隐瞒。(但后果我不负责:)),但不说实话就容易触犯面试红线,一票否决。

  2、 临近到期实务训练手册没有写完

  解决这个问题可以从四个角度着手,第一,可以将每行的字数控制在10到15字以内;第二,没有实习内容可以写的情况下,可以选择抄写法条及法律理论;第三,在内容排版上可以选择类似于ppt的写法,大部分内容都是框架,回车与空格相对比较多,但是笔记的内容又比较完整富有系统性,不容易让人认为是故意为之;第四,备注的部分可以选择不写,毕竟备注的区域占了每页板块的20%。

  3、 实务训练手册需要指导老师写12个月的评语

  每页50个字以上的评语对大佬们而言,实在太多。实在找不到老师签字可以选择经老师同意认可的评价内容,然后由老师在每一页的最下边签上自己的姓名,表示对内容的认可。

  4、 怎么样准备案卷材料才能让考官尽可能提问自己能够回答出的问题呢?

  虽然面试要求是提供案卷材料,但是只对提供的数量做了要求,具体提哪些材料并没有给出明确的规定。在办案确实超过10个以上的情况下,尽可能有针对性选择及准备案件。我根据自己的经验给出三条小的建议:对案件进行三次深层次的分类。第一次分类:将准备的案件分为值得问与不值得问的案件,有些案卷材料考官一看就会问一些固定的问题,或者甚至不问问题,这一类我称之为不值得问案件。比如:发送律师函、其他简单的法律专项事务等等;第二次分类:不值得问的材料应当占到50%以下,过了这个度有可能考官对面试人是否能够达到独立执业的水平产生怀疑,这就弄巧成拙了;第三次分类:全程跟踪的案件、自己对案情内容及法律关系比较了解的案件我称之为值得问的案件,毕竟这类案件考官与你一问一答,考官也会很爽。这类案件的材料需要进一步分类,尽可能将类别集中到某一法律领域或案由下,如都属于民间借贷合同纠纷。如果考官面对5份民间借贷案件与面对2份民事案件,2份刑事案件,1份非诉项目,考官的问题可猜测性是不是显然会有所区别呢?

  参考方案:5个民间借贷纠纷案卷,2个发送律师函的案卷,2个常年法律顾问案卷,1个专项法律服务案卷。

  (二)面试环节的小技巧

  面试是至关重要的关节,下面将会从【心理辅导】、【了解考官】、【具体建议】三个方面提供一些小技巧。

  1、心理辅导

  在讲解这个问题之前,需要跟大家做一个简单的心理辅导,增加大家在这个环节的面试信心:

  ●面试整体的通过比例>90%

  ●政治素质、道德品行、执业素质、实习表现每项达到及格即可通过

  ●红线项(绝不能出错项)并没有关于专业知识掌握情况的。可以理解为:专业知识掌握情况可以有点瑕疵

  ●不通过的后果不等于不能执业,只是延迟执业

  下面重点介绍下红线项(绝不能出错项):

  ●拥护中华人民共和国宪法

  ●是否符合申请实习应当符合的条件(管理办法第5条)及是否存在不宜从事律师执业的不良品行(管理办法第6条)

  以上两条可以忽略,能够参加面试的朋友基本都已经满足。

  ●诚信意识和敬业精神

  面对回避不了的问题,切记诚信回答。否则很容易遭到一票否决。

  ●提交的各项考核材料的真实性

  材料尽可能全面熟悉,不要让考官对材料的真实性产生怀疑。

  ●律师职业道德和实习纪律遵守情况

  比如,实习律师不能独立执业。

  以上这几点都是硬伤,大家千万不要触碰。

  2、考官究竟从你的答案里究竟想要什么?

  脑补考官大脑中的想法:

  "告诉我,这案子都是你实际参与的,你具备了独立执业的基本能力,并且没有触犯红线项。"

  3、考官可能会问什么?

  【案情事实】:通过案情事实的掌握情况间接了解是否亲自办理了案件。

  【案件相关基本专业知识】:如民间借贷纠纷中关于24%到36%的利息法院是否支持的条件是什么?

  【律所基本情况】:通过基本情况的掌握情况了解是否真实在所内工作,特别是针对有挂证嫌疑的面试同学。

  4、给大家的具体建议

  【自我介绍准备充分】:可以考虑主动引导考官问熟悉案件的情况。如;"我特别熟悉的案件是xxx...","我从头到尾跟下来的案件是xxx..."。

  【案件相关基本专业知识准备充分】:为了减少这部分的工作量,如果可以的话,选择案卷的类型尽可能单一较好。

  【态度良好】:面对考官的质疑,需要实事求是,态度谦虚并且不纠缠。

  【提前打探】:可以提前站在面试间门口了解面试考官的问题。

  重点提醒大家,孙子兵法从头到尾都不是一本关于如何以少胜多的奇书,他主张只有真正的实力才是取得胜利的关键。我的经验分享也并不是鼓励你试图利用"小技巧"去通过面试,只有用心在实习期间参与案件才是通过面试最大的法宝。
