New Superior Court Decision Creates Split In Authority About What Happens To Pending Appeals When Town Reaches 10% Subsidized Housing Threshold
Earlier this month, Mintz Levin’s Housing Practice Group issued an advisory regarding an Appeals Court decision that potentially undermined Chapter 40B by keeping alive an abutter group’s original appeal of a comprehensive permit to construct subsidized housing even though that permit had been later modified by the Housing Appeals Committee (HAC) and the same abutters group had filed a separate appeal of the modified permit.

Massachusetts Appeals Court Holds That Town Cannot Appeal Masshousing’s Chapter 40B Project Eligibility Determination In State Court
In a victory for the Massachusetts Housing Finance Agency ("MassHousing") and the subsidized housing developers whose projects the agency deems preliminarily eligible under G.L. c. 40B, §§ 20–23 ("Chapter 40B"), the Massachusetts Appeals Court has held that a municipal body could not go to state court to appeal the project eligibility determination MassHousing issued at the outset of a Chapter 40B comprehensive permit process.

SJC Holds That Diminution of Property Values Does Not Confer Standing to Challenge a Comprehensive Permit — Decision Also Addresses Standing Under the Zoning Act
In a decision that will be lauded by the subsidized housing community, and developers in general, the Supreme Judicial Court (the "SJC") has tossed out an abutter challenge to a comprehensive permit, ruling that a claim of diminution of property value does not confer standing to challenge a comprehensive permit issued pursuant to G.L. c. 40B, §§ 20-23 (the "Comprehensive Permit Statute").
