On 9th July 2011, the former Sudanese territory corresponding to the states of Bahr el Ghazal, Equatoria and Greater Upper Nile seceded from the Republic of Sudan and became the independent Republic of South Sudan. The disputed territory of Abyei has not voted whether to join the Republic of Sudan or South Sudan.
A Transitional Constitution is in place, but it is too early to say when industrial property legislation will be introduced, and a Registry established. The Constitution contains no provision for the continuation of existing Sudanese laws and rights, which indicates that Sudanese patents and trade mark registrations are not recognised in South Sudan.
