The government's latest proposal to kick start the housing market involves the government issuing further directives that local authorities should consider approaches by developers/promoters of schemes to review existing requirements secured via section 106 planning agreements (where planning permission has been granted in the past but which for viability reasons have not yet been implemented). Change to legislation is proposed to give this legal force. In the meantime if there are promoters of housing schemes who cannot deliver on schemes because of requirements contained in Section106 agreements, they should consider reviewing them to see whether changes to the agreement might enable them to develop the scheme sooner than waiting for economic climate to improve.
