In a
previous post, we commented on the High Court's decision in
Gard Marine & Energy Ltd v China National Chartering Co Ltd
(The "Ocean Victory") [2013] EWHC 2199 (Comm), which
dealt with an alleged breach of a safe port warranty.
The Court of Appeal has now reversed the High Court's
