イギリスのEU離脱の是非を問う国民投票において、離脱賛成票が52%を占め、反対票の48%を上回りました。このように、加盟国が国民投票により離脱を選択することは、EUの歴史上初めてのことです。それでは、今後どのようなことが起こるのでしょうか。

まず言えることは、イギリス及びその他のヨーロッパ諸国は長期的な不確定状態に晒されるということです。すなわち今回の国民投票は、イギリス議会に対し拘束力を持つわけではなく、実際に離脱決定を行うかどうか、離脱決定を行う場合でも離脱の時期及び離脱の方法について、今後イギリス議会は決定する必要があります。また、国民投票の開催決定の公表以降、金融機関やその他の企業が作成してきた緊急対応策も現在再検討されています。

なお、今後どのような手続きが取られるとしても、実際には、イギリスの離脱が成立するまで、少なくとも2年の期間がかかると考えられます。
すなわち、リスボン条約によると、加盟国が離脱するにはまず、50条通知が必要となります。そして当該通知の後、離脱合意の内容について、イギリスとEUが交渉を行うことになります。イギリスの離脱が成立し、EU条約の適用がなくなるのは、上記離脱合意の成立の日、または上記通知から2年(両社の合意により延長可能)経過時点のいずれかとなります。従って、上記交渉が行われている間は、イギリスは加盟国のままです。このため、イギリスのEU離脱は最短でも2018年の第3四半期頃になります。

EU離脱によって、イギリスでは、金融規制、労働法、競争法、データ保護法及び知的財産法を含む、大規模な法制の見直しが必要となります。このような大規模な見直しは、スコットランド、ウェールズ及び北アイルランド議会に委譲された立法権限にも及びます。今回の離脱は、EU残留を主張してきたスコットランド及び北アイルランドの民意に反する点が、事態をより複雑なものにすると考えられます。
