Global law firm Clyde & Co and specialist firm Law Essentials are investigating the commencement of a class action against Gladstone Ports Corporation Limited (GPC) on behalf of persons and businesses involved in, and reliant on, the fishing industry, who were negatively impacted by dredging, disposal operations and environmental monitoring undertaken in the Port of Gladstone from 2011.

The proposed class action will allege that these activities were carried out negligently and in breach of relevant project approvals and statutory duties.

As a result of the environmental harm, many commercial fishermen and other persons and businesses involved in the fisheries industry suffered significant financial loss commencing late 2011. Despite the fact that media coverage of the issue faded over the last few years, many of these businesses and persons continue to suffer financial loss today.

The losses experienced by the fisheries industry are widespread, ranging from claims by commercial crabbers/netters in the port, to commercial trawler operators that utilise fishing grounds between Yeppoon and Hervey Bay, to seafood processors and wholesalers.

"In excess of 250 claimants have already registered their interest to participate in the proposed class action. We are encouraging further people to register their interest as the involvement of a large group of people is critical to the proposed class action's success," Clyde & Co partner Maurice Thompson said.
