According to the New Jersey Administrative Office of the Courts, the month of March holds the highest amount of divorce filings throughout the year. The largest contributor to the trend is that it comes two months after January.
"Either people don't want to ruin the holidays or it's their New Year's resolution and they want a fresh start in the new year," said Fox Rothschild's Eric Solotoff, who serves as co-chair of the firm's family law practice.
The pattern appears to repeat itself after the summer.
"We also see an increase in September after summer vacation when the kids are back at school," Solotoff said.
According to Solotoff, the timing of a divorce is most often due to these emotional factors and the desire to hold it together for a family holiday or to give the kids one more vacation together.
Solotoff also goes on to speak on the economic downturn from 2008 to 2010, stating that some saw it as a time to cash out.
"These type of clients might think, 'If a court is going to use an average income (to award the spouse's settlement), then let's do an average that includes a couple of lean years,'" he said. "We've seen some of that."
