Catherine T. Barbieri was featured in the CBS Philly article, "Attorney Talks About Limitations of Free Speech on Social Media." Full text can be found in the May 22, 2014, issue, but a synopsis is noted below.

With social media usage continuing to rise, many are left wondering if what they say and do on social media sites can be used against them by their boss.

"Employees certainly have the ability to go onto Facebook and complain to their friends about what they like or don't like about work," says Catherine T. Barbieri.

"But where they run into problems typically is if they're making comments harassing some other coworker in violation of a nonharassment policy or if those communications share some sort of trade secret information from the company," she said.

The National Labor Relations Board says workers have the right to discuss work conditions without fear of retribution, even on social media sites.

"I typically would advise employers not to have a specific restriction on employee ability to engage in social media activities about their wages," Barbieri said.
