FTC/DOJ issue a Proposed Statement of Antitrust Enforcement Policy Regarding ACOs Participating in the Medicare Shared Savings Program that establishes a safe harbor for certain ACOs and mandatory federal antitrust enforcement agency review for certain other ACOs. ACOs will need to determine their respective shares of common services in primary service areas prior to submitting an application for participation in the Medicare Shared Savings Program.
