On July 22, 2013, Congressman Jared Polis filed suit in Denver County District Court against Sundance Energy, Inc.  In his lawsuit, Polis sought to obtain a restraining order that would prevent Sundance from further operations until further order of the Court.

The well is located in Weld County, Colorado.  According to the complaint filed by Polis, Sundance's operations are on adjacent property located approximately 50 feet from the property owned by Polis' holding company, Mountain Property Improvement, LLC.  The complaint does not seek any monetary damages, but merely seeks to stop Sundance from proceeding with its operations at the site.  Polis, a Boulder Democrat who represents Colorado's 2nd Congressional District, once represented Weld County but no longer does as a result of redistricting. 

On Friday, June 26, a hearing that had been scheduled was cancelled.  Rather than proceed forward, Polis dismissed his lawsuit.  According to Polis, his attorneys took the action to enable his legal team to gather more evidence in support of his case.  It remains to be seen what Congressman Polis' end game is, but the North American Shale Blog will continue to monitor this case.
