U.S. Citizenship and Immigration Services (USCIS) announced today that premium processing will resume for all I-129 and I-140 petitions in phases throughout the month of June. Please note that these dates are subject to change.

What Happened?

Beginning June 1, 2020, premium processing may be added to any I-140 cases (EB-1, EB-2, and EB-3) that would normally allow premium processing moving forward.

Beginning June 8, 2020, any H-1B petitions pending adjudication with USCIS and not subject to the CAP can apply for premium processing. This does not include petitions that are cap-exempt. In addition, any other non-H-1B I-129 application pending on or before June 8th that would normally allow premium processing can be upgraded to premium. This includes E-1, E-2, H-2B, H-3, L-1A, L-1B, LZ, O-1, O-2, P-1, P-1S, P-2, P-2S, P-3, P-3S, Q-1, R-1, TN-1 and TN-2 petitions.

Beginning June 15, 2020, premium processing can be filed concurrently with all H-1B petitions not subject to the CAP.

Beginning June 22, 2020, premium processing will be available to all H-1B petitions, including CAP petitions, and all other I-129 petitions that are eligible for Premium Processing. This includes E-1, E-2, H-2B, H-3, L-1A, L-1B, LZ, O-1, O-2, P-1, P-1S, P-2, P-2S, P-3, P-3S, Q-1, R-1, TN-1 and TN-2 petitions.

Who Does This Impact?

This impacts all Form I-129 and Form I-140 based petitions that need to be processed with the Form I-907 for premium processing. Please see the visa categories above.

How are Envoy and GIA responding?

GIA will be reviewing cases that are available for premium processing, utilizing the timetable above where applicable.
