A few weeks ago, I wrote about the EEO-1 Component 2 2017 and 2018 data submission deadline on September 30. On September 27, the EEOC announced in a court filing that collection of Component 2 data is continuing as long as "the Court's order is in effect stating that collection will not be complete until it reaches what the Court has determined to be the target response rate. . ." The court referred to is the District Court for D.C., where the EEO-1 Component 2 case is pending, and the target response rate is set at 72.7%. As of September 25, the EEOC disclosed a Component 2 response rate of 39.7%.

While this may be cause for relief if you are still struggling to collect your Component 2 data, don't relax too much because this extension could be short-lived. It is possible that the response rate rose sharply right at the deadline, meaning that the EEOC might soon close the collection portal. Because there is no way to track the response rate until the EEOC makes another disclosure, we don't know how much longer the extension will last. With this in mind, if you haven't submitted your Component 2 data yet, be glad for the extension but prioritize submitting that data!
