A Trademark shall mean everything that takes a distinctive form such as names, words, signatures, characters, codes, numbers, signposts, seals, drawings, sounds, smells, pictures, inscriptions, packaging, figurative elements, figures, colours, combinations of colours, or any combination thereof or any other sign or a group of signs if used or intended to be used in distinguishing goods or services of an establishment from goods or services of another establishment , or to indicate the performance of certain services, or to distinguish goods or services as regards their source, ingredients, method of manufacture, quality, identity, or any other characteristics.

Filing Requirements

  • Power of attorney legalised by the Consulate of Bahrain or appostilled.
  • Copy of the certificate of incorporation and extract from the commercial register.

Notes

  • Late filing of documents: allowed within 3 months from filing date without penalty.
  • Extension of time for late filing of documents: not allowed.

Renewal Requirements

  • Power of attorney legalised by the Consulate of Bahrain or appostilled.
  • Photocopy of the registration certificate of the subject mark.

Search Requirements

  • No documents are required.

Assignment Requirements

  • Power of attorney by the assignor, legalised by the Consulate of Bahrain or appostilled.
  • Power of attorney by the assignee., legalised by the Consulate of Bahrain or appostilled
  • Deed of assignment signed by the assignor and assignee, legalised or appostilled.
  • Copy of the certificate of incorporation and extract from the commercial register.

Merger Requirements

  • Power of attorney legalised by the Consulate of Bahrain or appostilled.
  • Merger agreement document signed by both parties, legalised or appostilled.
  • Copy of the certificate of incorporation and extract from the commercial register.

Recordal of Change

  • Power of attorney legalised by the Consulate of Bahrain or appostilled.
  • A letter from the proprietors addressed to the Registrar of Trademark in Bahrain stating their request to effect the change of name or address.

License Requirements

  • Power of attorney signed by the licensee and licensor, legalised by the Consulate of Bahrain or appostilled.
  • License agreement document signed by the parties, legalised by the Consulate of Bahrain or appostilled.

Notes

It is possible to record change transactions (name, address, assignment, merger, etc) either for applications under examination (before issuing an acceptance decision for publication by the Trademark Office) or for registered trademarks.
