On May 29, 2019, Federal Decree No. 9,806/2019 ("Federal Decree") was published, amending and repealing provisions of the regulation of the National Environmental Policy (Federal Decree No. 99,274/1990), which stablished the composition of the Federal Environmental Council.

Among the innovations, Federal Decree suppressed the participation of representatives from:

  • Federal and State Public Attorneys' Office and Consumer Protection Committee from the Chamber of Deputies;
  • National Water Agency ("ANA") and Chico Mendes Institute for the Biodiversity Conservation ("ICMBIO");
  • Each one of the State Governments and the Federal District;

Ministries and business entities which will be represented were listed and new participants were also listed:

  • Two representatives of municipalities, among the state capitals;
  • One representative per geographic region, as defined by State Government.

In addition, the Special Chamber of Appeals, responsible for the final judgment of fines and other penalties imposed by the Federal Environmental Agency ("IBAMA") was extinguished.

Federal Decree entered into force on May 29, 2019.
