On March 16, 2015, the Secretariat of Foreign Trade (SECEX) of the Ministry of Development, Industry and Foreign Trade (MDIC) initiated a new anti-dumping investigation in Brazil, as follows:

  • Circular SECEX N. 15, of March 13, 2015 – Initiation of an anti-dumping investigation, in Brazil, on the imports digital and analogical panoramic X-ray (NCM 9022.13.11 and 9022.12.00) from Germany. The petitioner is Dabi Atlante S/A Indústria Médica Odontológica.

An anti-dumping investigation is an administrative proceeding that lasts approximately 12 (twelve) months and that may or may not result in the application of an anti-dumping duty. If an anti-dumping duty is applied, it will remain in force for 5 (five) years.

The investigating authorities will send questionnaires to the importers, foreign producers and exporters of the investigated products, which have up to 60 (sixty) days to submit their responses. By submitting the response to the questionnaire, a foreign producer and/or an exporter may receive individual dumping margins, which should be significantly lower than the dumping margin applied to the companies that did not take part in the investigation.
