Guidance published by the Committee for Economic Development has clarified the position in relation to EU citizens working in Guernsey and the free movement of staff within the Common Travel Area (CTA).

The position of EU/EEA/Swiss citizens and their families resident in Guernsey will change after 31 December 2020, when the transition period ends.

For those EU/EEA/Swiss citizens who wish to remain in Guernsey (or the wider Bailiwick) beyond 31 December 2020, they will be required to apply under the EU/EEA/Swiss Settlement Scheme. This will allow the preservation of those employees and their family members' rights in relation to healthcare, employment and access to public services.

There is a six months grace period from 1 January 2021 within which to apply under the settlement scheme. The deadline to apply is therefore 30 June 2021. All EU nationals, EEA citizens or Swiss nationals will be required to apply for a visa to enter the Bailiwick prior to entry.

From an employer's perspective, businesses in Guernsey who rely on the free movement of their workforce between Guernsey and the EU/EEA/Switzerland will be required to check all members of their workforce are in possession of the correct documentation prior to travel.
