シンガポールを仲裁地とする仲裁において、仲裁廷は管轄の有無について自ら判断する権限を有しています。これに対し、当事者はその判断についてシンガポール高等法院に審査を求めることができます。この申立てがあった場合、シンガポール高等法院がどのような基準で仲裁手続を停止させるかについては必ずしも明確ではありませんでした。しかし、シンガポール高等法院は、AYY

Anor事件において、仲裁手続を停止しなければ当事者に回復不能な損害を生じさせることを当事者が合理的で信頼性の高い証拠によって立証した場合に限り仲裁手続が停止されると判断し、仲裁手続が停止される場合を極めて限定的なものとする基準を示しました(AYY
v AYZ & Anor, [2015] SGHCR22)。
この判断はシンガポールの仲裁法が世界で最も仲裁手続を尊重する仲裁法の一つであることを示すものであり、シンガポールを仲裁地とする仲裁を更に促進させるであろうと評価されています。
