A new Mexican Industrial Property Law will be enacted in the near future. No surprises are expected, as no more faculties will be given to the law. The main and principal changes will occur in the litigation field, and although at the present time infringements and precautional measures exist, these measures cannot be considered as totally effective. What the new provisions of the Law are looking for is a better structure and strength of the sanctions of the same.

Certain attorneys specialized in Industrial Property matters propose that the new regulations must contain provisions which permit the adoption of the opposition system in the trademarks field, as well as several other provisions related to the dilution of trademarks, as a criteria of protection thereof.

The Mexican Institute of Industrial Property and some attorney groups, such as the Mexican Attorneys Bar and the Mexican Association of Industrial Property Attorneys are presently studying, commenting and improving the Law project. We expect that this new Law project be passed on to the Congress for its discussion and approval soon.
