Amending the Provisions of the Notary Public

Law No. 186 of 2020

On September 5th, 2020, President Abdel Fattah Al-Sisi promulgated Law No. 186 of 2020 amending some provisions of the Notary Public law that was published in the Official Gazette to be enacted on March 4th, 2021.

As of the date of entry into force, property owners will be prohibited from dealing with electricity, water, gas companies, authorities, ministries, and the like, by transferring such facilities, or take any action unless the registration number for such title deed is submitted. Nevertheless, if the owner obtains a final judgment evidencing certain property rights, then the judgment must also be registered in a special register in the Notary Public, the number for which will correspond to the registration number of the title deed.

Following this, the new law aims to protect the properties from being abused as well as negatively impact the investments, since property owners,  regardless of whether they own a unit or land, shall not have the right to obtain a loan from banks with a non-registered property. Furthermore, the lack of registration of properties has historically been a source for excessive property disputes, along with the loss of third-parties' rights.

By contrast, Art. 934 of the Egyptian Civil Code stipulates that ownership and other real rights, shall not be transferred between the contracting parties or vis-à-vis third parties, unless registered. Historically, individuals would not register the transferred properties, but rather, conclude a preliminary sale and purchase agreement, obtain a verdict on the validation of the parties' signatures on such SPA, or use inheritance certificates in order to dispose of the assets within the deceased's estate. Consequently, it was imperative to issue this law to restore matters to their proper order.

Despite this, the legislator has simplified the procedures for property transfer registration, as well as setting charging nominal fees to encourage individuals to register their properties.

In conclusion, this enactment of this law assists in the Egyptian state's combat against corruption, since through registration, an individuals' property and the legitimacy of funds can be traced, in a way that reduces the crimes of bribery and tax evasion, whilst also helping to develop the Egyptian Notary Public through the payment of registration fees.

بتاريخ 5 سبتمبر 2020، أصدر الرئيس عبد الفتاح السيسي القانون رقم 186 لسنة 2020 بتعديل بعض احكام الشهر العقاري وتم نشره بالجريدة الرسمية ليعمل به من 4 مارس 2021.

واعتباراً من تاريخ سريان القانون لن يتمكن صاحب الشأن من التعامل مع شركات الكهرباء والمياه والغاز وغيرها من الشركات والجهات والوزارات في نقل المرافق او الخدمات او اتخاذ أي اجراء الا بعد تقديم السند الذي يحمل رقم الشهر، فإذا كان سند صاحب الشأن حكماً نهائياً بحق من حقوق الملكية فيجب التأشير بالحكم في سجل خاص في الشهر العقاري ويترتب عليه الاثار المترتبة على شهر المحرر.

ويهدف هذا القانون الي حماية الملكية من الاعتداء عليها والتأثير السلبي على الاستثمارات، حيث لا يملك مالك الوحدة او الأرض الحصول على قرض من البنك بضمان ملكية غير مسجلة، كما ان الطرق العرفية أدت الي ارتفاع المنازعات على الملكيات وضياع حقوق الكثيرين.

وبينما نصت المادة 934 من القانون المدني علي ان الملكية العقارية والحقوق العينية الأخرى لا تنتقل سواء اكان ذلك فيما بين المتعاقدين ام كان في حق الغير إلا بالتسجيل. اعتاد الافراد على عدم نقل ملكية العقارات والاكتفاء بعقد البيع الابتدائي والحصول على حكم بصحة التوقيع على هذا العقد او التعامل بإعلام الوراثة على ما اّل إليهم بالميراث من أراضي فضاء او عقارات، وبالتالي كان يتحتم اصدار هذا القانون لإعادة الأمور لنصابها الصحيح.

سيما وان المشرع في القانون الذي تم تعديله يسر من إجراءات تسجيل نقل الملكية بالإضافة الي انه قد وضع رسوم مقبولة للغاية لتشجيع المواطنين على تسجيل ملكيتهم.

في النهاية يعد هذا القانون نقلة تشريعية ويمثل صورة من صور مكافحة الدولة المصرية للفساد حيث يمكن من خلال التسجيل تتبع ملكية الافراد ومشروعية الاموال بما يقلل من جرائم الرشوة والتهرب الضريبي ومن ناحية اخري فأن الرسوم التي ستدفع مقابل التسجيل ستساعد على تطوير مصلحة الشهر العقاري
