Important notification of four new guidelines for the compilation of mandatory codes of practice, which are binding in terms of the Mine Health and Safety Act 29 of 1996 ("the MHSA").

Kindly take note that on Friday, 5 February 2016, notices were published in Government Gazette No. 39656, in terms of which the Chief Inspector of Mines of the Mine Health and Safety Inspectorate of the Department of Mineral Resources issued the following new guidelines for the compilation of mandatory codes of practice in terms of section 9(3) of the MHSA:

  • Guideline for the compilation of a Mandatory Code of Practice for an Occupational Health Programme (Occupational Hygiene and Medical Surveillance) on Thermal Stress (effective date: 1 July 2016) ( click here to view Notice R.146 of 2016).
  • Guideline for the compilation of a Mandatory Code of Practice on the Minimum Standards of Fitness to Perform Work on a Mine (effective date: 30 June 2016) ( click here to view Notice R.147 of 2016).
  • Guideline for the compilation of a Mandatory Code of Practice on the Right to Refuse Dangerous Work and Leave a Dangerous Working Place (effective date: 1 July 2016) ( click here to view Notice R.148 of 2016).
  • Guideline for the compilation of a Mandatory Code of Practice for the Management of Medical Incapacity due to Ill-Health and Injury (effective date: 31 May 2016) ( click here to view Notice R.149 of 2016).
