自新冠状病毒疫情发生以来,中国中央政府及各地方政府均采取了非常严格的防控措施,其他一些国家地区也陆续采取了入境管制等措施以防止疫情在全球范围内继续扩散。该疫情本身及因此而采取的防控措施等不可避免会对部分工程合同的履行产生不利影响。
事实上,我们近期已经收到不少客户的咨询,包括承包商是否可以援引不可抗力索赔或是否存在其他可能的权利救济,以及如果收到合同相对方的不可抗力通知该如何应对等。考虑到大部分海外工程都可能面临类似的问题,本所特将咨询意见中针对性较强的几点梳理总结如下,以期对工程相关方有所帮助
