A new Bill on Amendment of the Tax on Goods and Services Act and the Fiscal Penal Code Act was published on 24 June 2019. The Bill calls for the implementation into Poland’s legal system of what are known as quick fixes in intra-EU transactions, provided for in Council Directive (EU) 2018/1910 of 4 December 2018 amending Directive 2006/112/EC.

The changes provided for in the Bill and resulting from the amendment of the EU VAT Implementing Regulation will bring about substantial changes in reporting intra-EU transactions, starting from 1 January 2020. The major changes are to include:

  • EU-wide standardization of procedures for documenting intra-community supplies of goods (significant changes compared to the regulations currently in place);
  • simplification of VAT procedures for goods deliveries to call off stock (greater availability of the simplified procedures throughout the EU);
  • changes regarding indications of place of supply in chain transactions (involving multiple entities in the supply chain but when goods are shipped directly from the first supplier to the final buyer).

The Bill may still be modified in later stages of the legislative process but it is to be expected that most of the proposed amendments will be eventually promulgated.
