近年、中国独禁法執行当局は、従業員が個人用のスマートフォンを使い仕事に関する交信をした記録のスクリーンショットを、独禁法違反事件の証拠として提出することが増えてきています。当局は、このような証拠をいかなる手段で入手するかは不明です。企業がその従業員の個人用スマートフォン内の交信等を監視するのはプライバシーの観点から困難であり、上記のような執行当局がこれら交信記録を独禁法違反の証拠とするリスクに対する対策が必要です。
対策としては、従業員が個人所有のスマートフォンを仕事に一切使用しないよう厳格に禁止し、代わりに、企業は仕事に使用するための専用のスマートフォンを従業員へ配布する等のことが考えられます。
