On September 19, a California federal court dismissed three of the six claims against a
computer networking equipment manufacturer, including an allegation
of unfair practices under the FTC Act. The court noted that
"[t]he pleading problem the FTC faces concerns the first
element of injury. The FTC does not allege any actual consumer
injury in the form of a monetary loss or an actual incident where
sensitive data was accessed or exposed."
