ITC Ruling Offers Chance For Infringer Reprieve From Import Bans

Mark Whitaker spoke to Bloomberg Law about
the U.S. International Trade Commission's (ITC) suspension of
an import ban on drones because of a U.S. Patent and Trademark
Office review that gives accused infringers an opening to escape a
financially costly ban on moving goods into the country.
"It gives a little bit of light where there was none before
for respondents," Mark said. "If you have any inkling
that you may be having a complaint brought against you in the ITC,
and you know the patents that are going to be asserted, you should
start your work right then on an [inter partes review]."
